Abstract:

The objective of this paper is to evaluate the basis for determination of property rights to groundwater in Texas, and to consider the implications of existing groundwater legislation for the future of the Texas economy. First, the legal development of groundwater legislation is analyzed. Second, groundwater legislation in Texas is examined both in terms of its efficiency and equity in dealing with potential groundwater problems. Finally, the paper concludes with an economic assessment of property rights to groundwater, focusing on economic efficiency and incentives for conservation.
