Abstract:

The scope of Federal immunity from liability for damages caused by flood control operations is quite extensive. A review of the legislative history and case law of the immunity provision, 33 USCA 702c, reveals that application of the provision varies among the various Federal judicial districts. The review also reveals evidence that the scope of the provision should be narrowed.
