Abstract:

This paper presents a consulting engineer's perspective on the impact of litigation on foundation engineering practice in the United States. It consists primarily of the review of contributions by other engineers, by professional liability insurance carriers, and by professional and business organizations (ASCE, ASFE, and ACEC). Some long-term improvements are recommended, including increased use of alternative dispute resolution techniques in lieu of litigation, and of peer review procedures to improve the quality of engineering services.
