Abstract:

The Electric Consumers Protection Act of 1986 ('ECPA') has imposed significant new environmental criteria on the hydroelectric licensing process under Part I of the Federal Power Act. These requirements apply with full force to the original licensing process, as well as to relicensing proceedings. The FERC has undertaken a major effort, including the institution of various rulemaking proceedings, to implement the new statutory provisions. This paper reviews ECPA's environmental provisions.
