Abstract:

The state public utilities commissions wield enormous power over the destiny of small hydro projects; power extending over rates, contract terms and dispute resolution. Yet developers have been slow to exercise their rights in these forums. Getting into the hearing room is easy, as consumer groups have shown in recent years. Even without the help of an attorney, participation in the process is not difficult and the issues will be familiar to most who have ever tried to develop a project. Still, small hydro developers have not been a driving force in the hearing room.
