Abstract:

There is a continuing search for a way to combine private financing, using tax benefits provided under the Internal Revenue Code, with the municipal preference provided under the Federal Power Act. This search has produced a confusing and at times contradictory line of cases exploring the line between permitted and prohibited public and private combinations. The purpose of this paper is to describe the current state of the law on municipal preference.
