Abstract:

The United States Ninth Circuit Court of Appeals decision of May 15, 1984, now requires Federal agencies and potential licensees to be more responsive to public needs and requirements. Based upon a review of legislative and regulatory procedures, the results generally reaffirm certain secretarial authorities and define procedural changes. The decision impacts the actions of all Federal agencies having legislative or regulatory responsibilities affected by the enforcement of certain sections of the FPA. Ultimately, the process of applying the decision, as appropriate to each case or projects, provides a clearer, and more consistent, means for identifying and protecting the justifiable interests of the United States.
