Abstract:

Property owners and others affected by erosion caused by an inlet's interference with the natural littoral drift have legal rights. Those rights are based upon traditional and historical theories of law which can be applied to address this particular modern problem. Three theories of the common law, which were recently the basis of a court's decision in November, 1990, are described in this paper. Additionally, other theories are available under state statutory and federal case authority.
