Abstract:

Local land use regulations managing stormwater runoff in new urban developments are the most practical and effective method to control pollutants in urban stormwater runoff or prevent flooding problems. The Clean Water Act provides for financial assistance to construct the pollution control portion of sewer projects and planning and regulatory powers to control stormwater runoff pollution. Legal considerations relating to adopting, administering and enforcing local land development regulations include authority to adopt, delegation of legislative powers, reasonableness of police powers, equal protection of activities and taking property without just compensation.
