Abstract:

The Engineers Joint Contract Document Committee has produced revised documents, which are available from ASCE. The committee includes ASCE, the National Society of Professional Engineers, the American Consulting Engineers Council and the Construction Specifications Institute. The group was created in 1978 and soon afterward formulated these documents focusing on engineer-owner relationships. Some were revised in 1983, and the new revisions are the first since then. The General Conditions is the principal document among the dozen available. There are many new provisions and changes in these Conditions that affect parties to a construction project and these are described. Among them are provisions relating to hazardous wastes found on a construction site, provisions for alternate dispute resolution forums, and the use of two separate contract times, one for substantial completion and one for final completion. The revised Conditions do not speak to damages for delay, and therefore do not rule these out. This is a significant change.
