Abstract: This paper presents recent observations of the misuse of technical definition, hydrologic concepts, sedimentation engineering principles, and flood control regulations by the legal profession during litigation involving property damages caused by various kinds of hydrologic events. Recommendations are offered so that prospective expert witnesses and technical advisors can avoid the embarrassment and possible professional discreditation associated with theatrical courtroom procedures.
