This paper describes the attitudes of society today on the use of litigation to collect financial compensation for alleged damages in product liability and professional liability situations. Methods which engineering managers are using to combat the attitudes, including insurance, loss prevention programs, conflict resolution, arbitration, mediation-arbitration, peer review and tort reform, are considered.
